CIVIL SITTINGS Thursday, February 15. (Before his Honor Mr Justice Cooper.) M'intyre v. drake and others. Claim for rescission of a, contract 011 the ground of misrepresentation in respect to a properly purchased by the plaintiff at Selwyn, North-East Valley. Mr Wilkinson appeared for llio plaintiff (Daniel M'lntyre) and Mr Sim for the defendants (John Drake and James Samson and Co.). Mr Sim asked for an adjournment. The plaintiff, who was & material witness for the plaintiff's case, was indisposed and not able to go into the witness box. Mr Wilkinson sid the matter had now been hung up for some months, and he had all his witnesses present. Mr Sim said all his witnesses were in attendance too. Hi 6 Honor said h« must accept the statement of plaintiff's counsel that the plaintiff was a material witness. He could not under the circumstances force the case on. The case whs adjourned for ft week, the plaintiff to pay £3 3s professional coats and witnesses' expenses for the day.
