Alexander Duncan v. Archibald M'Donald.— Claim _E2, mouey lent.—Mr A. S. Adams for the plaintiff.—Judgment for plaintiff by default, with costs. , :
' Christen3en and Co. v. Carl Rochloff (of Grey : town).—Claim £4 10s, oh a promissory rote.—Mr Baron for the plaintiff.—Judgment for plaintiff, with costs.
John Sidey v. Ewen Canieion (of Middlemarchy—Claim £'50 3s ld, portion of tbe cost of a dividing fence between certain sections of land at Nenthorn.—Mr T. K. Sidey appeared for the plaintiff, and Mr Sim for the'defendant.— The facts of the case were practically hot disputed, lhe claim was for half'of the original cost of the dividing fence between properties at Nenthorn. When the properties were held respectively by the late John Sidey, jun., and the late Henry Orbell a fence was erected by Johu Sidey, jun., ond Henry Oibell entered into an agreement for tha payment Of his quota of the cost. After the decease of the parties to the agreement one part of the land became vested in the present plaintiff, and the other was divided and held by different persons. The portion held by the present defendant has pas«6d through l-everal hands, and has twice reverted to the Crown and beep relet. The.proccediugs were to recover from the present occupier half the original cost of the dividing fence.— After evidence and argument, M r Carew reserved judgment.
