Sunday Fishing.—Peter Lawson was charged with, unlawfully workiug at his calling as a fisherman on Sunday, December 9, in view of a public place (Otago Heads), such work not being a work of necessity or charity.—Mr Platts, for defendant, pleaded 'Not guilty."—Sergeant ipeerin said the information was laid under section 16 of "The Police Offences Act 1884." Frequent complaints had been made in respect to Sunday fishing, and he had received a petition signed by 55 fishermen requesting the police to bring the matter before the court, so as to have the matter tried.—Constable Treacy aaid he left Port Chalmers at 1 p.m. on Sunday, 9th inst., to intercept any fishing boats On going down the harbour he met defendant's boat, and in answer to questions defendant stated that, although the boat was in his charge, it belonged to Mr Tannage, whose place he left at 2 a.m. that day, and went to the fishing grounds at the heads and: caught the 20doz barracouta which was in the boat, which they would deliver to Mr Tunnage. They received Is par dozen for them, and paid 2s in the pound of their earnings to Mr Tunnsße for the use of the burnt — In answer to Mr Platts, witness stated tiiat Anderson, who was in the boat with defendant, said they caught the fish between four and ri-ve miles outside the head*. Witness was not sure whether they could be seen fißhing from tke public road at the heads, bat from the road at the South Head they could be seen.—His Worship said it was unnecessary to go any further with the case, the evidence showing that the men were more than three miles away from the headß. He dismissed the case.—Mr Platts remarked flint beside the fact that the men were beyond the territorial limits of the colony, there wore several other fatal objections to the success of the prosecution.—Similar charges asaiiißt William Gibbon, Charles Anderson, and Charles Sullivan were withdrawn.
