BENEFIT OF THE DOUBT

Mr roynton, S.M., dismissed a charge against the Auckland Milk Company that it sold milk that failed to stand what is known as the reductane test. The sample was taken from one of the company’s milkmen. For the defence it was contended that the test knbtvn as the methylene blue test was not reliable, but the regulation is uncertain and unreasonable, and that proper precautions were not taken between the buying of the sample and application of the test. The magistrate said the regulations undoubtedly meant milk “when purchased.” , Though the milk in questiou would not stand the test at 10 a.m., it might have done so at 6.55 a.m.. when purchased. He found that the test wa» satisfactory and reliable, and the regulation was not unreasonable; There was doubt whether or not the milk would have passed the test when purchased. Defendant was entitled to the benefit of the doubt, and the charge was dismissed.
