WATERSIDER’S MISHAP
CLAIM AGAINST COMPANY.
FULL COURT RESERVES DECISION.
The Full Court, consisting of the Chief Justice (Sir Robert Stout), Mr Justice Herdman, Mr Justice Hosking, Mr Justice Salmon!, and Mr Justice Reed, heard further argument yesterday with reference to the application for a. new trial brought forward by the Union Steam Ship Corapapy of New Zealand, Ltd. The company, represented by Mr P. Levi and Mr C. G. White, were defendants in a compensation claim brought against them in the Supreme Court by a waterside worker named John William Boyce, for whom appeared Mr O. C. Mazongarb.
The plaintiff was awarded the sum of Ss€l U§_ damages by the jury. The claim was based on an accident which had befallen the plaintiff while engaged working on one of the defendant company’s ships. The plaintiff moved for judgment, and the defendants later moved for a new trial. Eventually, however, the matter was referred to the Full Court for consideration.
After hearing Mr Mazengarb, the Chief Justice said the court would take time to consider the matter. If the members of the court desired to hear counsel for the defendants they would be notified accordingly.
