HIS FATHER’S ESTATE
NOVEL CLAIM AT AUCKLAND. Somewhat novel circumstances surrounded an application to Sir John Salmond at the Supreme Court at Auckland, when T.. G. A. Mackenzie (Mr J. B. Johnston) sought maintenance out of his father’s estate. Applicant’s father was the Rev. Alexander Mackenzie, Presbyterian minister, late of Avondale, who by his will left practically the whole of his property, valued at about £ISOO (which included his library), to the City Council. The library was given to the council the residue of the estate, about £IOO, being for its upkeep and extension. A sum of £5, together with some small gifts, including a gold watch, silver jug, etc., were left to the applicant, a married man, with six of a family. Mr A. H. Johnston represented the City Council, and Dr. Fitchett the Public Trustee.
Mr Johnston said that subject to His Honour’s approval the parties had agreed to a settlement under which the council and the son each take half of the residue of the estate.
Hia Honour questioned whether it was a matter that could bo settled by consent, and said that as the bequest to the City Council was a public charity the Attorney-General ought to bo represented. The proceedings were therefore to allow hnn to be joined. < .. '. .i. in . . 1
