CURIOUS LAW POINT
ATTORNEY-GENERAL SUES A COLONEL. MONEY PAID IN ERROR. Australian an<f N.Z. Cable Association (Received March 17, 10.55 p.m.) LONDON, March 16. A curious point in law arose in a case heard before the King’s Bench Division. The Attorney-General sued Colonel Borissov; for £'5900, paid by mistake in July, 1919, in consequence of the British Consul at Murmansk telegraphing in cypher to the Foreign Office tolling them to credit Colonel Borissov with 4000 roubles. When tho telegram was received it road 400,000, forty roubles then being worth a pound. Colonel Borissov repaid tho Government 4000, but said ho could not give the rest, as ho had immediately invested £5900 in business. Colonel Borissov gave evidence that he was employed at Vickers’s, and had telegraphed to relatives in Russia to send as much money as possible. The judgo decided that Colonel Borissov must have known there had been a mistake, and gave judgment for; the Attorney-General for £5900.
