"UNDUE HARDSHIP"
NOT WHEN RENT IS OWING. A decision of the utmost importanoi' to landlords and tenants —' especially Uie latter —was given by Mr W. G. Riddell, S.M., at the Magistrate's Court yesterday, in respect _of An action "brought by George Fair Browne, of Wellington, cabinetmaker, and Frank Robert Waters, of Wellington, printer (Mr R. Kennedy) against Lewis Gestro, of No. 14, Pitt street, Wadestown, butcher, (Mr P. W. Jackson), for possession of a dwelling, and £9-10s rent. A defence of "undue hardship"* w*a set up, but air Riddell held that even though such an answer was sound!, In many cases, it could not be considered in those where the rent had been allowed to fall in arrearß. The- defendant was ordered to vacate the tenement by April 23rd and to rvay -the amount of the claim, witi' costs.
