AN UNUSUAL PLEA
STATUTE OF LIMITATIONS. It is not often that the Statute of Limitations is put forward us a defence in civil action, but such occurred at tho Magistrate’s Court yesterday, when Waller J. Jorgenson, settler (Mr J. J. McGrath), sued Thomas P. Lyons, hotel-keeper, of Levin (Mr C. B. O'Donnell), for £lO la 3d, an amount alleged to be due as balance of rental for a farm property at Kilbirnie.
Council for the defendant, in making the special plea, said he did _so because of the difficulty of defending an action brought with reference to a matter over seven years old. Nevertheless, his client was quite prepared to enter the witness-box and deny that be owed plaintiff any money. After Mr Lyons had taken this course, Air McGrath elected to bo non-suited. Judgment was entered accordingly.
