Pago, S.M., in, tlie Magistrate’s Court, yesterday delivered his decision in the ease arising out of the official police inspection on the ponny-in-slot* machines at the Lyall Bay gala on. January 3rd. The alleged offensive subjects, were exhibited by Walter E. Mercer, nnd.horo •what were described as suggestive inscriptions. ~ . , Mr Page said he had closely the pictures and arrived at the conclusion that it was impossible to convict the defendant. “A number are very close to the border/’ the Magistrate said, 'and are certainly not edifying, and no good purpose was served by thorn. Tney fall short of criminal indecency, although the titles were suggestive." An order for the return of the pictures was made by the Magistrate.
