FAILURE TO MAINTAIN
EQUIVALENT TO DESERTION.
A case under the amended divorce law of last session, whereby failure to maintain may constitute a ground for a decree- was heard in the Supremo Court yesterday morning, before His Honour the Chief Justice (Sir Robert Stout). The parties were Agnes Elizabeth King (petitioner) and George Alfred King, of Dunedin (respondent). Mr W. A. Sim appeared for the petitioner, and the respondent was also in attendance. Evidence was given by the petitioner that during the past five years she had received no maintenance from her husband. This was admitted by the respondent. His Honour explained that under the new Act of 1913 failure to pay maintenance was equivalent to desertion, and the petitioner was entitled to a decree. No charge was mad© against the respondent of any misconduct other than what the law called desertion. A decree nisi would be entered, to be moved absolute after three months. ■There was one child of the marriage, and an order , was made to enable the respondent to see the child at monthly intervals.
