TERMS OF AGREEMENT

ALL UNIONS TO COME UNDER ARBITRATION AOT. The agreement between the men and the employers is similar to that previously in existence, but all the unions are brought under the Arbitration Aci. It is as follows: 1. Subject to agreement being arrived at between the parties, the Minister for Marine bo requested to reinstate the Shipping Act suspended bv his authority. 2. That the agreement as to wages and other conditions of employment, dated Wellington, January 24th, 1912. shall as soon as possible (subject to the consequential alteration of the dates in clauses 32 and 33 and the deletion of all the words after the word “Aparima” in clause 33 of the said agreement) bo renewed for a term ending December 31st, 1916. 3. The Auckland branch of the Federated Seamen’s Union of Australasia

to remain registered under tho Indus* trial Conciliation and Arbitration Act and tho Dunedin and Wellington branches undertake to register under the same Act forthwith. 4. When renewed, tho aforesaid referred—to,agreements to be registered at Auckland. Wellington, and Dunedin under the Industrial Concililation and Arbitration Act aa industrial agreements. 5. Tho Federated Seamen’s Union of Australasia undertakes that its members will from the date of this agreement, accept employment on any of the ships on the terms contained in tho said I’greoment dated January 24th, 1912, and (subject to their rights in terms of the Shipping Act and agreement referred to herein) that such members will not refuse to remain in such employment or to perform their usual duties on board ships in accordance with law and their articles of agreement. 6. That the steamship owners undertake that as far as reasonably possible, the members of the Federated Seamen’s Union, if they so desire, go back bo tho ships they left, provided the said ships and men are in tho same port on the resumption of work by tho seamen, and that they (tho owners) will instruct their ships’ officers accordingly. 7. Tile Federated Seamen’s Union of Australasia undertakes that any legally qualified men for Homo trade, intercolonial or foreign trading ships employed by tho steamship owners between October 22nd, 1913, and the date hereof, shall bo permitted to join any branch of tho above-named union on payment of the entrance foo, and shall, provided they are financial members, not be subjected to any differential treatment as compared with tho other members of tho said union. 8. The Northern Steam Ship Company, Limited, Auckland, agrees that, subject to tho following variations, a will not make any agreement with the new Auckland Seamen’s and Firemen's Union on terras other than those contained in the seamen’s agreement dated Wellington, January 24th, 1912 The variations are: — (a) By adding the following proviso to clause 5 ol the said agreement: “The provision? of this clause as to payment of an extra day’s sea pay when a vessel leaves Auckland on a Sunday shall not apply to tho steamers Waimnno, Taniwha, or Kauieri whilst engaged in their present trades or to any vessels of tho same character trading in substitution for tho said vessels.” (b) Clause 31 of the said agreement dated Wellington, January 24th, 1912, to be amended by striking out the word: from “steamers trading to “the said vessels,” and substituting tha following:—“Steamers trading within river or extended river limits, and the Northern Steam Ship Company’s steamers trading between Auckland and the East Coast ports.” (c) That employment in the Northern Steam Ship Company’s steamers will be open to members of tho Federated Seamen's Union of Australasia/ as well as to tho members of the Auckland Seamen’s and Firemen’s Union. 9. On tho representatives of the steamship _ owners and Federated Seamen’s Union of Australasia agreeing to tho foregoing terms they shall immediately lie submitted to tho members of the said union for approval, and on ratification by them the mem. bors of the said union shall immediately return to employment in tho ships (and subject to the provisions of clause 8 hereof) on the conditions prevailing prior to ceasing work.
