S 11, ,n tho Magistrate's Court on Saturday, when Albert James Davcy, agent, of otratford, cued Michael Daniel Murphy, farmer, formerly of Wanganui, for £73 19s. being commission at the rate of £2 IQs per cent, on £2957 17s in connection with a sale cf defendant's prperty at Westmere, Wanganui. through the instrumentality of the plaintiff. Plaintiff ret out that hearing defendant was about to leave the Dominion and had loft Wanganui, ho left Stratford at 1 pm. on Thursday, and after travelling by motor-car all night arrived in Wellington about 11.30 a.m. on Friday. He <v“nt immediately to the office of Messrs Field, Lucky and Toogood (solicitors), where He found the defendant in the custody of the bailiff of the Magistrate’s Court, who 1 ad arrested him on a writ which had 1 ecu issued at Wanganui iu respect to another claim Although defendant had remitted a draft for £350 to the Bank of" England, at London, lie did not appear to have sufficient money with him to satisfy tho claim. The bailiff, in execution of his duty, proceeded to malic arrangements for defendant to be returned to Wanganui, but bofo.-o the train left defendant made arrangements to pay the amount, and was accordingly leloased. The summons in respect 1 o the present claim was issued on Friday after* noon, and called on defendant to ant car before the court at 10 o-m. on Saturday. The defendant, who was stated to lave made arrangements to leave for England by the boat leaving Lyttelton on Saturday next, did not appear, and Hr Toogood. who appeared for the plaintiff, proceeded to prove the claim in Ills absence. After hearing tho evidence of tho plaintiff in regard to the sale of the property, etc... his Worship adjourned tho ca-o till 2.15 P-m to-day, in order that certain papers might ho obtained from. Stratford.
