Plaintiff’s case was so involved, bv reason of sub-leases, that the Magistrate advised him to get proper legal advice as to the position. Air Hindmarsh appeared for defendant. Thomas James Stokes sued George Jones for £O2 4s Gd, on tho ground of the alleged unskilful erection of a house, and for work done in connection with the premises. A conntcr-claim for £35 4s 7d for fittings supplied and commission on tho sale of plaintiff’s house, was put in. Mr Wilford raised four nonsuit points:—(l) That the contract was alleged to bo according to plans and specifications, and no specifications had been proved; (2) t'he complete contract had existed since April last by performance, payment, delivery and possession; 13) that as no objection was taken to the contract, there was a waiver to that objection, and consequently an estoppel ; (4) that tho plaintiff acquiesced and stood by. Judgment on the points raised was reserved until the 28th inst. Mr Bolton appeared for plaintiff.
