Tuesday,"August 17. (Before his Honor, the Chief Justice.) Mr. H. H. Travers applied for a certificate of complete discharge on behalf of O. It. Miller, and there being no opposition, the application was granted. On the application of Mr. Fitz Gerald, the deed of assignment in the estate of Neff King was declared to have been completely executed. . Thos. Scott and another, ex paHe National Bank.—This was a case heard under slimmons, the trustee id the estate of Scott aud Co. being called upon to show cause why the snm of £2OB 7s. 3d. should not be paid to the National Bank. Mr. Brandon represented the bank, aud Mr. Forwood the trustee (Mr. Port). Affidavits produced went to show that Scott and Co. assigned their estate, and paid ss. in the £. After the dividend had been paid the bank made a claim on account of promissory notes for £833 9s. 3d., backed by H. J. Smith, who had since become bankrupt. The question was whether the trustee was now liable. The case was adjourned for a fortnight. Mr. Xi’itzherhert : applied for a discharge on behalf of George M. Summerfiold. Mr. Gully opposed, and stated that the creditors had passed a resolution suspending the debtor’s discharge for three years. His Honor said he could see nothing to support the resolution of the creditors, and unless good cause were shown he should not feel justified in acting upon it. On the other hand, the debtor had not shown anything in his favor. He should suspend the certificate of * discharge till the Ist November nest.
