Wb observe that the Provincial Secretary has advertised for tenders from persons desiring to' contract for the erection of the Wanganui Bridge. Mr. I toy, the Provincial Engineer, is to be at Wanganui on or about the sth of December, to afford information on the spot lenders are to be received up to noon on the 24 th December, at the II inland Hotel, Hau ganui. The sum of .£5OOO for the Wanganui Bridge appears in the Appropriation Act, ns one of the sums which “may be issued and applied for defraying the charge of the Government of the Province,/or the year commencing January Is/, ending December Bls/, 1857.” There is no law authorising the issuing and applying of any sum whatever for defraying that or any other charge of the Government of the Province, after the 31st December, 1857. Probably, therefore, no legal payment can be made by the Treasurer under arty such contract, until another Appropriation Act shall have been passed. ’I he entering into the contract before the end of the year will not legalize any payment under it made after the end of the year. Caveat Contractor! It does not follow that the new Council will refuse to appropriate a sufficient sum ; but the contractor should satisfy himself that the Government with whom he agrees, has legal authority to make the payments.
