Percy Hawkins, of Collingwood, took action against the Slate River Hydraulic Sluicing Company for £ISOO damages, founded upon the claim that the company wrongfully took possession of certain works which formed the subject of a contract between the company and the plaintiff for the erection of a large dam on the company’s sluicing claim. The action was originally brought in the Supreme Court, Nelson, and a special jury awarded £942 damages, but the Court held that the action should have been brought in the Warden’s Court, and remitted it there nceording--ly. The case in the Warden’s Court, which commenced on the 12th August and concluded on the 16th, presented a different aspect from the suit in the Supreme Court-, inasmuch as the company had completed the work and wa3 in a position to prove chat the work had cost considerably more than the original contract price. _ The fire assessors brought in a verdict for £950 in favour of the plaintiff. Certain nonsuit points were raised on which judgment has been reserved, to be delivered in Collingwood on the 10th September. Mr Pitt and Mr Hayes appeared for the plaintiff, and Mr Myers and Mr Magm* nitr for the defendant.
