Percy Hawkins, of Collingwood, took action against the Slate River Hydraulic Sluicing Company for £ISOO damages, founded upon the claim that the company wrongfully took possession of certain works which formed the subject of a contract between the company and the plaintiff for the erection of a large dam on the company’s sluicing claim. The action was originally brought in the Supreme Court, Nelson, and a special jury awarded £942 damages, but the Court held that the action should have been brought in the Warden’s Court, and remitted it there nceording--ly. The case in the Warden’s Court, which commenced on the 12th August and concluded on the 16th, presented a different aspect from the suit in the Supreme Court-, inasmuch as the company had completed the work and wa3 in a position to prove chat the work had cost considerably more than the original contract price. _ The fire assessors brought in a verdict for £950 in favour of the plaintiff.
