THE KIRBY CASE.

It will be remembered that after Kirby’s arrest we published in our columns a statement headed “ Further Particulars Relating to the ex-Detective.” This was considered to be libellous, and Mr Jellicoe, on Kirby’s behalf, prosecuted and obtainc-.d the committal for trial of Messrs Cassidy and Ash bolt, the manager and printer of this journal, on a charge of libel. A true bill was found by the Grand Jury at the last Supreme Court sittings, but, owing to Mr Cassidy’s very severe illness, Mr Jellicoe intimated to the Court his intention to withdraw the charge; but Avhilst the necessary steps were proceeding to obtain that object we, unfortunately, published in our columns a paragraph from another newspaper relating to the ex-detective, and which Kirby’s advisers deemed a renewal of the libel, the subject of the indictment. Wo desire now to express our regret and that of Messrs Cassidy and Ashbolt for the publication in question.
