POWERS OF PRESIDENT OWNER'S CHALLENGE FAILS (P.A.) WELLINGTON, Wednesday Judgment in favour of the president of tlio Now Zealand Racing Conference was given by Mr Justice Blair today on a motion for an injunction restraining the president from acting 011 a recent amendment to the llules of Racing which enables him to cancel the registration of horses. Plaintiff was Henry Brick man, beauty specialist, Masterton, owner of the horses Salmi, Kinsman and Hinepo, and defendant was H. It. Chalmers, bank manager, of Wellington. The hearing was iield on Monday. "All persons who take advantage of the opportunities provided for racing horses and winning prizes thereat," said His Honor, "know what are the terms j and conditions laid down in the Rules of Racing and by entering and taking advantage of those opportunities they elect to be bound by all such rules. And when discretions are conferred by those rules upon any officer of the Racing Conference all horse owners are well aware of the important powers conferred upon the conference officers and all honourable racehorse owners are well j content absolutely to rely upon their justice and fairness." His Honor said the submission of counsel for plaintiff that the president's discretion under the amended rule was absolute put the position correctly. That being so, in the circumstances of such an organisation as the Racing Conference and constituted as it was, that discretion could not be interfered with by the Court unless bad faitli on the part of the president could be shown. None was alleged.

SHOP CLOSING HOURS MAIN ISSUE UNSETTLED OPPOSITION TO PROPOSAL "A false impression has been created by the last paragraph of the announcement in yesterday's Herald regarding the proposed adjournment of the hearing by the Court of Arbitration of the shop assistants' and grocers' cases," said Mr W. E. Anderson, secretary of the Auckland Employers Association, yesterday. "The paragraph infers that these cases have been completely settled and that the settlements will be made into awards by the Court. "The settlements which have been reached are subscribed to by a minority of the employers only. The majority, on the grounds of public interest and for other reasons, are very strongly opposed to the proposal to close shops on Saturday morning, and will be heard by the Court before awards are made." The proposed adjournment has also caused concern to the Auckland Suburban Retailers' Association. The association, although not a party to the dispute, intended to present evidence in support of the present suburban hours, which involve closing on Friday evenings and opening on Saturday mornincs.

The Court will hoar the application for adjournment this morning.

LAUNCHES AT TAUPO (0.C.) TAUPO, Wednesday Replying to a deputation from the Taupo Rood Board, which met him recently at Taupo, the Minister in charge of Tourist Resorts, Mr Parry, said the Government was considering a launch harbour scheme just below the Taupo wharf on the Waikato River at Taupo, costing approximately £10,00(1 and capable of holding 27 launches. The usual launch harbour in this vicinity was destroyed by the raising of the lake level which allowed the waves from the lake when a southerly wind was blowing to beat right in. The area it is proposed to develop is at present swamp between the wharf and the boat sheas. MR SCRIMGEOUR LEAVES The former controller of the National Commercial Broadcasting Service, Mr C. G. Scrimgeour, left yesterday by flving-boat for Sydney. Mr Scrimgeour intends to mako his home in Australia, where members of his family will join him shortly. He held his broadcasting appointment from the inception of the service until June, 1943. Later he was posted to the Royal New Zealand Air iforce as an aircraftman.
