DUNEDIN, Friday A medical practitioner, Robert Findlav Allan, was charged in the City Police Court to-day with supplying incorrect or misleading particulars relating to an application by Philip Idour for a motor-driver's licence. It was alleged that, in support of his application, Idour submitted a certificate given by Dr. Allan, who had examined him on October 2 for the purpose of manpower requirements, to the effect that he had cardiac disease and was not fit for heavy work. At the same time, lie produced a later certificate from I)r. Allan which stated that the pulsations of his heart were natural and the sounds those of health. After considerable evidence had been heard, counsel for the defence submitted that a prosecution could not lie in law because the opinion given was defendant's opinion and. no matter how unsound it might be, it was removed from misrepresentation. The hearing was adjourned until .Monday. ASSAULTED FOREMAN LABOURER SENT TO GAOL Sentence of two months' imprisonment was imposed by Mr. J. H. Luxford, S.M., yesterday, on Cyril Alfred Porter, a labourer, aged 24 (Mr. Noble), who admitted a charge of assault. Senior-Detective Walsh said that accused assaulted his foreman when the latter took away a bottle of beer accused was drinking on the job. Counsel said accused had too much of the lighting spirit and had acted on im pulse. The magistrate remarked that the evidence showed it was a brutal assault.
