WILL INTERPRETATION LAPSE OF ONE BEQUEST (0.C.) HAMILTON, Wednesday A "will made by the late Major R. G. V. Parker, of Hamilton East, who left an estate valued at £23.000. came before the Chief Justice. Sir Michael Myers, in Hamilton to-day for interpretation. -Major Parker bequeathed a fourth share of his estate to his daughter, Daisy Helen Parker, who predeceased him. The question the Court was asked to decide was whether the testator had provided for Daisy Helen Parker's share in his will in the event of her death.

Mr. L. P. Leary represented the children, Mr. F. H. Haigh the grandchildren. and Mr. C. F. Henry the trustee, the Guardian Trust and Executors Company of New Zealand, Limited. His Honor said the will had been inartistically drawn, and one clause contained a construction that was contrary to the Wills Act. He saw no reason for altering the language of the will. His Honor held that as far as Daisy Helen Parker was concerned there was a lapse, and there was intestacy with respect to the share bequeathed to her. The costs of all parties were ordered to bo paid out of the estate.
