EMPLOYER NOT LIABLE
FARM TRUCK ON ROAD (0.C.) WHANGARET, Tuesday
The liability of an employer for the acts of his employee was considered in the Whangarei -Court when an Auckland business man with farm interests in the Whangarei County was proceeded against by the Transport Department for operating r> motor-vehicle without a current registration or a current certificate of fitness.
It was explained to the Court that the employer had a truck for use on the farm, and it did not require registration or a warrant of fitness. Against the employer's orders a share-milker had taken the vehicle on the road and had been stopped by a Transport Department inspector. The employer made infrequent visits to the farm. The inspector, questioned as to the reason for taking action against the employer, said he was acting under instructions from his head office.
Mr. Raymond Ferner, S.M., dismissed the charge, holding that the employer was not responsible.
