INTOXICATED DRIVER
FINE OF £lO IMPOSED A charge of being intoxicated in charge of a motor-truck in Great North Road on Monday was admitted by an army staff-sergeant, Alfred Oswald Duncan, aged 44 (Mr. Allan J. Moody), before Mr. F. K. Hunt, S.M.. yesterday. Senior-Sergeant Joyce said that while driving an army truck toward Avondale accused failed to give way to a taxi and a collision occurred. The truck turned over and the taxi was damaged. Accused, who admitted he had had five drinks during the afternoon, was subsequently examined by a doctor and found to be under the influence of liquor and unfit to have control of a motor vehicle. Mr. Moody said that because of the shock accused's condition was worse after the accident than before .He would be disciplined by the army and charged under the army regulations. Evidence of accused's previous good character was given by an army officer. "In view of his good record I will not deal with him as I should," said the magistrate, in imposing a fine of £lO. "That is about a fifth of what he should be fined." Accused's civil driving licence was cancelled and lie was ordered to take out a prohibition order.
