ONE MAN SENT TO GAOL CASE OF SECOND ACCUSED QUESTION OF NEW TRIAL One of two men who had been found guilty of stealing a wallet of notes from a Maori in a Hobson Street house, Edward McFarland, aged 29. came before Mr. Justice Fair for sentence in the Supremo Court yesterday. Mr. Robinson, who appeared for him, said he had come to New Zealand from America 10 years ago and had a wife and three children here. His wife had persuaded him to arrange to return to his people in America and get away from bad associates here. His Honor said the prisoner had . a bad record, but hafl been doi'iig a little better during the last four He had been given a chance by a magistrate last Ocfober and was on probation when this offence was committed. He would bo sentenced to two months' imprisonment. A motion for a new trial was set down on behalf of Victor Lynn Norris, aged 32, who was found guilty in association with McFarland of the theft of a wallet from a Maori. Mr. Justice Fair informed his counsel, Mr. Henry, that he was considering granting Norris two years' probation on terms.

Mr. Henry said that in that case the motion for a new trial would probably iiot bo gone on with, and the case was adjourned until to-day.
