APPEAL ALLOWED
CABLE AND WIRELESS HAILE SELASSIE'S CLAIM SUM OF £IO,OOO INVOLVED (Received December 7, 5.5 p.m.) LONDON, Dec. 6 In view of Britain's do jure recognition of the King of Italy's Emperorship of Abyssinia, the Court of Appeal allowed the appeal of Cable and Wireless, Limited, against tho verdict in favour of Haile Selassie. « Judgment in favour of the former Emperor of Abyssinia, Haile Selassie, in his claim against Cable and Wireless, Limited, was given by Mr. Justice C. A. Bennett on July 27. Ho said there was doubt whether defendants could safely pay plaintiff and a stay of execution was granted in view of an appeal. Costs were allowed to plaintiff. Haile Selassie claimed £10,613 from the company as due under an agreement, which the company contended applied to whomsoever was the sovereign of Ethiopia. A reply from the Foreign Office on the question, which was read at a previous hearing of the case, stated that Britain recognised the Italian Government as the Government de facto of virtually the whole of Ethiopia. , , The Italian Government was asked if it would accept the decision of an English Court. It replied that it claimed the money itself and was not prepared to admit that its rights were in any way in doubt.
