CLAIM FOR DAMAGES A DRIVER'S INJURED ARM COMPLETION OF EVIDENCE The lioariiifj; of a claim for damages arising out of a motor collision on the Auckland-Waiwera IJoad near Hadfield's Beach last Boxing Day was continued before Hi*. Justice I'air and a jury in the Supremo Court yesterday. The claim, which wns for £2500 general ami £>{7o special damages, was brought by Arthur Rupert Brunton, of Northcote, baker (l)r. McF.lroy), against Algar Walter Ferguson, of Auckland, motor-car salesman (Mr. Richmond). The cars collided while going in opposite directions, and plaintiff, who was driving at the time, claimed that his arm had been so injured that be would not he able to carry on bis old occupation or any other requiring the use. of both arms.

Continuing his evidence in crossexamination yesterday defendant said that when the accident appeared imminent he pulled over sharply to the left and called out, "Hold on." The crash occurred immediately afterward. The cars did not lock, but sheered off. Jn re-examination defendant said that when he drove off from the scene of the accident be did not realise the extent of the. damage to his car. lie had not bad anything to drink that day.

A passenger in defendant's car, Miss Ksta Bentata, saleswoman, said there was no drinking in the car. It was ridiculous to suggest that they had been travelling at CO miles an hour. Plaintiff's car seemed to be approaching fast and it was on the wrong side. A garage proprietor, Alfred Torea Grundy, said that defendant's car was of a type that held the road well ami was a safo car to handle on a corner.

In answer to the foreman of the jury witness said there was no damage to the bumper of defendant's car.

Woodycar Smith, an agricultural inspector, said that defendant had been travelling slowly shortly before the accident.

Mr. Richmond addressed the jury and Dr. McElroy had not quite completed his address when the Court adjourned until this morning.
