SEQUEL TO ACCIDENT
£3BO DAMAGES AWARDED WOMAN THROWN FROM GIG Further medical evidence in opposition to a woman's claim for damages for injuries was heard by Mr. Justice Callan and a jury in.the Supreme Courf, yesterday. The plaintiff was Mrs. Lucy Ellen Morilleau (Mr. Fawcett).: of Otahului, who claimed £I4OO general and £ll7 10s special damages from Kiri Kukutai (Mr.' Richmond), bushman, of Tuakau. When plaintiff was driving a horse and gig along the Great South Road on February 22 the gig was struck by an -overtaking motor-car driven by defendant, and plaintiff was thrown out on her head on the road.v-'' ■'
Defendant admitted that the accident had been due to his negligence but tested the amount of damages, denying that . plaintiff had suffered" the ; injury-to health that she claimed: .J Cailed by Mr. Richmond, Dr. J. W/ J. Johnson, who said he / had known | plaintiff since 1933, stated that it did not necessarily follow that a recurrence of her illness was due to the accident. "' Her condition could be cured without, difficulty. The operation she had was . not in any, way .rendered necessary by ; 'i the accident. Six months; would be a ' reasonable time to assess for her j recovery from effects of the accident. .;4 Mr.. K. Mackenzie expressed the opinion that plaintiff would get great"? relief after this litigation was over.
