In this action the respondent originally claimed against the appellants as executors of the will of Samuel William Butson, his father, £B2B 2s Id for board and lodging, work and labour done and material supplied, etc. Mr. Justice Kennedy, who tried the action at Invercargill in August, 19.'5(3, held that the liability for board andlodging was not substantiated, but that work and labour was done and material supplied in the ordinary way of business and that they were to be paid for.
