QUESTION OF OWNERSHIP MR. J. MOLLISON'S MACHINE LONDON, Nov. 12 .An injunction to restrain Mr. James Mollison from flying his Bellanca monoplane to Capetown in an attempt to break the record has been sought by the Irish Hospitals Sweepstake Trust. The trust alleged in the Chancery Court to-day that the Bellanca is its property, and was purchased two years ago. Since then it had been located in America, but action had not been taken until it had been returned to the jurisdiction of the British Courts. The trust desired the question of ownership to be settled. Mollison's counsel stated that the airman was the innocent party. He blamed the Bellanca company for selling the machine to Mollison after having sold it to the trust. A temporary injunction was granted. The Bellanca, which was formerly known as the Irish Swoop, was entered by Colonel Fitzmausrice in the LondonMelbourne air race in October, 1934. It was withdrawn just before the start because it did not comply with the loading conditions. Mollison flew it on his record Atlantic flight on November G, and had planned to take off in it to trv and lower C. W. j A. Scott's record to Johannesburg and Mrs. Mollison's to Capetown.
