MAREO APPEAL
NEW TRIAL SOUGHT VERDICT CHALLENGED APPLICATION TO COURT EARLY STEPS TO BE TAKEN An application for a new trial for Eric Mareo, who was found guilty and sentenced to death on Wednesday night on a charge of having murdered his wife, Thelma Clarice Mareo, is to be made by Mareo's counsel. Jt was officially stated lost night that a request would be made to Mr. Justice Fair, who presided over the trial, for leave to appeal to the Court of Appeal for a new trial on the grounds that the verdict was against the weight of evidence. The application will probably be heard in chambers as soon as the necessary formalities have been complied with. An announcement in this connection is expected shortly. It was reported yesterday that there was a possibility of evidence for the defence, which was not available at the time of the Supreme Court trial, being obtained from' Australia. It was mentioned that the question of fresh evidence was exclusively one for a new trial. Arrangements had been made for Graham Mareo and Elizabeth Patricia (Betty) Mareo to sail by the Ruahme for England from Wellington on March 7. Yesterday their passages were cancelled. If the application for a new trial is successful, their evidence will be required.
