JUDGMENT REVERSED
SINGER'S DAMAGES SUIT MANAGER'S APPEAL SUCCEEDS SYDNEY. Feb. 20 Sir Benjamin Fuller was successful in an appeal to the Full Court against a verdict of the Supreme Court on October 14 given in favour of Miss Ruth Portrate, aged 22, opera singer. She was awarded £SOO damages arising out of her dismissal after the first rehearsal of " La Tosca " when she had been engaged for 22 weeks at £2O a week for the last grand opera season. The Chief Justice held that there was no evidence on which reasonable men could find that Sir Benjamin was not genuinely dissatisfied with Miss Portrate's performance of her engagement. The Court set aside the verdict and entered judgment for Sir Benjamin.
