DAMAGES FOR SINGER
BREACH OF OPERA CONTRACT SIR BENJAMIN FULLER SUED (Received October 14, 11.55 p.m.) SYDNEY. Oct. 14 Miss Ruth Portrate, an operatic soprano, was awarded £SOO damages against Sir Benjamin Fuller in the Supreme Court to-day, for breach of a contract arising out of the last grand opera season. Miss Portrate obtained a 22-weeks' engagement at £2O a week, but was dismissed after the first rehearsal of "La Tosca." The defence was that although there was no complaint about the quality of Miss Portrato's voice, she lacked knowledge of "La Tosca," and a clause in her contract enabled Sir Benjamin Fuller to terminate her engagement in the event of her not proving satisfactory. The question at issue was whether the dissatisfaction was genuine or capricious.
Sir Benjamin Fuller has obtained a stay of proceedings for 21 days.
