TRAFFIC PROSECUTIONS
THE TAKING OF EVIDENCE COMMENT BY MAGISTRATE [by telegraph —OWN correspondent] PALMERSTON NORTH. Tuesday "1 do not agree with the Automobile Association taking evidence elsewhere; I would rather have it, taken here," stated the magistrate, Mr. J. L. Stout, when dealing with a by-law case. A Wellington motorist was charged with a breach of local regulations. Counsel for defendant had said that the Automobile Association (Wellington) was of opinion that where foreign parties were concerned depositions of evidence should be permissible to avoid unnecessary costs.
"I would rather have witnesses in the box," said the magistrate. "A great deal depends upon how they give their evidence and act there. A lot of untruths are told in Court in connection with motor accident cases, and to take evidence on commission would be opening tlio door a bit wider."
