BIRKENHEAD COUNCIL
Sir—Uecentlv a member of the Birkenhead Borough Council resigned throufill ill-health. It is left to the council to fill the vacancy without holding a by-election. This is dono on the mound of economy; and is to be applauded. But instead of bivihr the candidate who polled next below the successful man at last election the opportunity of accepting or refusing the seat, the council (not all of them) has approached 110 fewer than three persons who did not stand for election, to see if any of them will accept the seat. Now, this is wrong according to legal advice tendered, which says that if an election is not held, the unsuccessful candidate polling the next highest votes is entitled to be called on. Ibi.'j is only fair to the ratepayers that voted for him. I glory in frontal attack, but detest a stab in tho back, so 1 write this in frankness to those who supported me, and love fair play.
