application declined CATHOLIC PRIEST'S ACTION [BY TELEGRAPH—PRESS ASSOCIATION 1 : - -DUNEDIN. Saturday Holding that the testatrix was physically and mentally powerless to resist the execution, of her will or to express a wish, including her unwillingness or reluctance to sign, Mr. Justice Kenhedy gave judgment against plaintiff in a case in which Father Ardagh, Roman Catholic priest, made application for probate of the will of the late Catherine Cosgrove, of Gibbston. The action was brought by Father Ardagh for probate, appointing him executor and leaving the estate, subject to the life interest of a brother of. tho testatrix, to the Catholic Bishop of 33tmedin, to be divided and expended upon chafitable purposes. Some of the next of kin opposed and some supported the will, and others submitted to the judgment of the Court.
