SALE OF BUSINESS
FRUITERERS' DISPUTE PLAINTIFF GIVEN JUDGMENT A dispute arising out of the sale of a fruiterer's business in Parnell resulted in' Frank Hayward, of Parnell (Mr. Boyes), bringing proceedings against .John Parry, of Ponsonby (Mr. Haigh), in the Magistrate's Court, before Mr. F. K. Hunt, S.M., yesterday. It, was stated bv plaintiff, who claimed £56 14s, that on May 17 he agreed to purchase defendant's fruit business in Parnell Road, the price being £56 14s, including goods and chattels to the value of £lO. Plaintiff alleged that defendant wrongfully represented the average weekly turnover to be £ls, and the average weekly net profit to be £5. Plaintiff said he carried on the business from May 24 until Juno 21, and that during that period the total turnover was only £l6 3s lOd, out-of-pocket expenses amounting to £l9 2s 7d. Defendant denied that any representations he had ' mado about tho business were inaccurate.
Judgment was given for plaintiff, who was awarded £46 14s and costs.
