PRIVY COUNCIL CASE

NEW ZEALAND ACTION LEAVE TO APPEAL GRANTED LONDON, July 3 Tho Privy Council has granted leave to appeal in the caso of Vincent versus the Tauranga Electric-Power Board, New Zealand. An accident occurred on Juno 6, 1930, to Frederick Charles Vincent, an employee of the Tauranga EluctricPowor Board. With another employee ho was preparing to overhaul a transformer on To Matai Road. Ho was standing on the lid of tho transformer when he received a shock and fell to the ground, a distance of about 17ft. He was burned on one shoulder and both feet and also suffered minor injuries, but no bones were broken.

Subsequently Vincent sued the board for compensation and costs totalling £3477. His claim was heard in Auckland by Mr. Justice Smith, who found for defendant board. This judgment subsequently was upheld by the Court of Appeal, the case hinging on whether tho claim arose out of a contract or a tort.
