MARRIAGE FAILURES.

APPLICATIONS TO COURT. TWO AUCKLAND CASES. A decree nisi, to be made absolute after three months, was granted in the Supremo Court yesterday, by Mr. Justice Smith, in tho case of Mary Ann Petersen (Mr. Fawcett) against Hans I'eter Petersen. Petitioner said she was married to respondent at Masterton. In March, 1931, at Auckland, she was granted an order for the restitution of conjugal rights, but her husband had not complied with it.

In the case of Robert Tudor Pow'nall (Mr. Mackay) against Sara Pownall, His Honor granted an order for the restitution of conjugal rights, to take effect within 14 davs after service of the order. Petitioner said ho was married in 1914. Since July, 1929, when his wife entered hospital, they had been living apart. His wife left the hospital in October, 1929, and went to livo with her brother. She had since refused to see petitioner.

PETITIONS AT HAMILTON. DECREES IN SEVEN CASES. [from our own correspondent.] HAMILTON, Tuesday. Applications for decrees nisi were granted in undefended divorce petitions heard before Mr. Justice Herdman in tho Hamilton Supreme Court to-day. Rose Lavinia Hornblow sought the dissolution of her marriage with Robert Edward Hornblow, journalist, Kohukohu. Petitioner said the parties were married in March, 1907, at Dunedin, and had since lived at Mangaweka, Auckland and Dargaville. The petitioner and her husband were parties to a verbal agreement for separation entered into by them in December, 1927. The agreement had since been in full force. There were no children of the marriage. The petition was granted. Ella Marjorie Frank petitioned against Henry Walter Frank, labourer, Onenaka. Petitioned said her husband deserted her in January, 1928, two months after their marriage. Petitioner was granted the custody of the one child. Adultery was the grounds on which Walter Fiintoff, farmer, Ongarue, sought the dissolution of his marriage with Millicent Fiintoff. Charles Thomas Harrison, farm labourer, Ongarue, was named as co-respondent. A decree nisi was granted, petitioner to have the custody of the child. Co-respondent was ordered to pay the costs.

Evidence that a mutual agreement to separate, made in January, 1928, was given by Gwyndolyn Lilian Stewart in support of her petition against Wallace Stewart, musician, Gisborno. A decree nisi was granted. Evidence that petitioner and his wife mutually agreed to separate after living together for a year was given by Victor Foster Cray, salesman, Cambridge. Petitioner said he and his wife had not lived together since January, 1927. A decree nisi was issued. Decrees wero granted in tho following cases whero respondents had failed to comply with an order for the restitution of conjugal rights:—Charles James Asplin, labourer, Hamilton, against Salome Elizabeth Asplin; Geoffrey Day Gat land, motor mechanic, Hamilton, against Olivo Elizabeth May Gatland.
