STRUCK BY MOTOR-CAR.
DAMAGES CLAIM SUCCEEDS,
Judgment for £42 10s, and costs, was given in the Magistrate's Court yesterday by Mr. F. 11. Levie'n, S.M., in a cast* in which J. J. McCullough (Mr. Simpson) proceeded against R. J. Thomas (Mr. Lennard). The claim was for £BS 16s, and arose from an accident in' Broadway, Newmarket, on tho evening of April 25, when plaintiff was struck by a motor-car driven by defendant, and received injuries to the head and a fracture of the ankle. Tho magistrate stated that it was clear from tho evidence that defendant had not seen McCullough until he was within two feet of him. < Plaintiff was then stopping on to the safety zo:ie, and as there was 18ft. between the zone and footpath there was no need for the car to tiavel so- near the zone. The conclusion that ho had reached .was that, defendant had not been keeping a proper look-cut, and judgment would be given against him.
