SEQUEL TO FATALITY.
CHARGE AGAINST MOTORIST.
MAGISTRATE DISMISSES CASE.

A charge against Frederick Charles Facer, of having negligently driven a motor-car on the main road at Upper Hutt on August 10 so as to cause the death of Mrs. Florence Alton, aged 63, by knocking her down, was dismissed in the Magistrate's Court to-day, by Mr. E. Page, S.M., who held that the evidence for the prosecution was such that no jury would convict. Ho did not call on evidence for the defendant.
Deceased and her sister wero walking home along the side of the bitumen track wheji Facer's car pulled out from behind another car to pass it. The time was between lights and deceased was wearing a dark dress which made it difficult for the lights of Facer's car to render her visible. She was killed instantly.
