CHARGE OF ASSAULT.
ACQUITTAL ON RETRIAL. The retrial of Bertram Augustino O'Connor (Mr. Noble) on a charge of assaulting a woman, aged 20, with intent to do grievous bodily harm, was conducted before Mr. Justice Herdrnan in the Supreme Court yesterday. It was alleged the assault took place on the evening of March 28 on Western Springs Road, near the Morningsido reserve, and that it was committed with a piece of iron piping. Evidence was given along the lines of that tendered at the first trial, when the jury failed to agree after four and a-lialf hours. The retrial occupied tho whole afternoon, and tho jury retired just before tho tea adjournment. Tho jury returned with a verdict of not guilty shortly before nine o'clock, and accused was discharged.
