Residents and tho council alleged that during the months of July and August and up ?o Bcpit<rribnr 4, defendants permitted a srnoke nuisance to arise and continue at the factory in Balmoral l!oad. The proceedings were taken under the Health Act, 1920. Ten residents of Dexter Avenue, Mewturn Avenuo, Tcntcrden Avenue and Balmoral J'oad dcposi'(l to the nature and oxtent of tho nuisance during the period. Certain witnesses stated they had been inado ill by the funics, and their foodstuffs had been tainted.

That any nuisance existed was denied by tho defendant company, which admitted that on a few occasions choking of the furnace might have given cause for complaint. All possibility of further troublo was now avoided by remedial measures adopted for that purpose. In giving judgment, Mr. E. C. Cutten. 8.M., who had visited the factory, held that while there had been cause for complaint during tho period alleged, tho company had apparently taken steps to prevent a recurrence. Tho situation would bn met by ordering defendant company to pay costa, which amounted to £l2 2s.
