FORGERY AND UTTERING.
TWO BROTHERS CONVICTED. PREVIOUS BAD RECORD. [BX TELEGRAPH. —OWN CORRESPONDENT.] HAMILTON. Wednesday. Sentence of 12 months' imprisonment with hard labour was passed by Mr. Justice Herdman on Thomas Tuinbull and Robert Pryde Turn bull, brothers, who were found guilty in the Supreme Court, Hamilton, to-day, of forging a cheque for £9 8s in the name of Joseph Rawlinson, licencee of the Royal Hotel, Hamilton East, and uttering it to George D. W. Osborne, hotelkeeper, Kihikihi. The • accused, who were not represented by counsel, are serving a three years' sentence for breaking and entering at Dunedm. The evidence showed that, having obtained a cheque form at Hamilton, it was filled in for the amount named, payable to Robert Pryde, to the order of Joseph Rawlinson, and an endeavour was made to cash it at the Commercial Hotel, To Awajnutu. Failing there, accused proceeded to Kihikihi, where they received cash for the cheque at the Star Hotel. Thomas Turnbull, addressing the jury, said that he had been gassed during the war and was as a result subject to fits. He had made out the cheque while in a state bordering on insensibility. His Honor, addressing the jury, said the case was perfectly straightforward, the only question being whether the evidence was sufficient to warrant a conviction. After a short retirement the jury returned a verdict of guilty. The judge commented on prisoners previous bad record, and directed that the sentence of 12 months' imprisonment should commence at the expiration of the sentence they are now serving.
