CONCLUSION OF ACTION.

The hearing was concluded in the Supreme Court, before Mr. Justice Stringer, yesterday, of the action brought by the official assignee (Mr. West) against Roland Darcy Mens, a bankrupt farmer, of Hikntaia (Mr. Hampson), in respect of two business transactions which it was alleged had been carried out with intent to delay or hinder the settlement of the estate" by creditors —the giving of a mortgage by bankrupt to his brother-in-law, and the payment of £550 to his son. Mr. Hampson said the main question was whether the law was adequately laid down in connection with the preference of one creditor to others. Bankrupt was not bound to take the giving of the mortgage into consideration in estimating whether be was solvent or not. If he could pay his other debts he was entitled to disregard, mortgage liabilities, as these were secured. After lengthy legal argument decision was reserved.
