LIQUIDATION OF ESTATE.
MATTER FOR FULL COURT. ARGUMENT IN AUCKLAND. Legal argument concerning a shareholder's claim as a creditor in the liquidation of an estate, was heard before Mr. Justice Sim, Mr. Justice Stringer and Mr. Justice Herdman, in the Supreme Court yesterday. It is many years since a Full Court assembled in Auckland. The proceedings arose out of the winding up of a Hamilton company, Metal Stores, Ltd. A shareholder, James Joll (Mr. A. Tompkins), had desired to prove as a creditor, but the liquidator, Mr. A. E. Warnock (Mr. Ziman), had ruled negatively. After hearing counsel at Hamil ton Mr. Justice Stringer had decided in favour of plaintiff, but had left the liquidator the right of bringing the case before the Full Court. The proceedings yesterday were confined fo a delving into legal authorities and precedents, and judgment was reserved.
