INTERPRETATION OF DEED. A SUCCESSFUL APPEAL. [BY TELEGRAPH.—PRESS ASSOCIATION."] WELLINGTON, Tuesday. In October, the Court of Appeal, consisting of the Chief Justice, Hon. C. P. Skerrett,, Mr. Justice Stringer, Mr. Justice MacGregor and Mr. Justice Alpers, heard an appeal from the judgment delivered in the Supreme Court by Mr. Justice Sim. The matter in dispute was a deed of partnership between John McGillivray Watson and Arthur Bryan Haggitt. As the result of the decision of Mr. Justice Sim, Bertha Elinor Lillian Haggitt and others, executors of the will of the late Arthur Bryan Haggitt, appellants, continued an action in the Court of Appeal against John Lachlan McGillivray Watson, respondent. The decision of the Court has now been announced, it being stated by the Chief Justice that there has been a disagreement between members of the" Court, he himself considering the appeal; should be dismissed and the other three Judges considering it should be allowed. Accordingly . judgment was passed allowing the appeal with costs on the highest scale. On the application of counsel, provisional leave was granted for appeal to the Privy Council,
