INSURANCE DISPUTE.
REFUND OF PREMIUM SOUGHT MISREPRESENTATION ALLEGED. [BY TELEGRAPH. —OWN CORRESPONDENT. ] TE AWAMUTU. Thursday. In the Magistrate's Court at Te Awamutu this week, before Mr. Orr Walker, S.M., a Ngaroto farmer sought to recover from an insurance company the amount of a premium he had paid the company's agent on an insurance policy of £SOO. Plaintiff alleged misrepresentation in that the agent stated definitely that a bonus of per cent, per annum would be paid by the company, thereby increasing the £SOO to £750 in 20 years. It was stated that as a matter of fact the company's bonus was only 1 per cent. Counsel for the company said that up plicant had signed the draft agreement when paying the premium, and therefore knew the terms of the contract. In view of this fact the company was. not hound by any verbal promises made by its representative. Counsel for plaintiff quoted an English case which he said was parallel to "the present one. After some further argument, counsel accepted the magistrate's suggestion that both should submit, to him their arguments in writing and he would then give his decision.
