STOCK DEAL DISPUTE.

A claim for £92 16s 5d in connection with a cattle deal was made in the Magistrate's Court by Mrs.- M. S. Lynch against Albert Thompson. Defendant entered a counter-claim for £72 17s 2d in connection with a deal iri sheep. Arthur N. Lynch said he traded in his wife's name and all accounts in connection with his dealings in stpek were kept by his wife, who was the plaintiff in this case. Defendant and witness bought cattle at Taumarunui in the early part of last year. Witness actually purchased the cattle,, which consisted, of 74 head and the defendant agreed to go in half shares with them. The cattle were bought in Mrs. Lynch's name. Ihey were sent to Thompson at Feilding and were sold later. It had been agreed that the profit was to be divided between defendant and witness. The half share of profits had not been paid. Witness had received £350, hut there was still an amount owing. Plaintiff said the purchase, price of cattle was £395 lis. She had 7-eceivwi no account from defendant until last December. When cattle were sold she should have received a sale note. Defendant, a stock dealer, admitted having sold the cattle and said that as plaintiff owed him money on "a sheep deal lie had not been in-a hurrv to settle up the cattle account. His counter-claim was for a sheep deal. He made arrangements with Mr Lynch regarding the sheep on the same terms as: the cattle—they were to have half shares. The sheep were sold at a loss. Defendant had had no dealings with Mrs. Lynch in the transactions. A. N. Lynch denied that there was any arrangement of 'half shares on the sheep and that he had purchased them for Thompson. > , ' \ ■ Judgment was entered for plaintiff on the claim for £92 16s 5d and costs. On the counter-claim judgment was given for defendant for £72 17s 2d and costs.
