QUARREL AT TEA-TABLE.
EFFECT OF JURY'S VERDICT. LEGAL POSITION UNCERTAIN. Some doubt exists as to the legal effect of the verdict arrived at by the jury in the case of Edward Patrick Brogart, who, in respect of an affray following a quarre! at the tea-table concerning the good looks of a certain young woman, was found "guilty of common assault under provocation." When the prisoner appeared for sentence before Jlr. Justice Herdman in the Supreme Court yesterday, '.Mr. Paterson, for the Crown, submitted that the verdict was one of guilty, as provocation was no justification of an assault. Hts Honor said he thought it would be advisable to have the matter properly discussed before sentence was passed. Argument on the situation, was accordingly fixed for this morning,' prisoner being released in the meantime on Ins own recognisances.
