NO PROVISION FOR WIFE.
WILL IN BROTHER'!} FAVOUR. ESTATE AWARDED TO WIDOW. An application under the Family Protection Act for the upsetting of the will of Ker deceased husband, William Scarff, was made by Winifred Scarff (Mr. Quartley), in the Supreme Court yesterday before Mr. Justice Herdman. Mr. Cocker appeared for the Public Trustee, representing the only beneficiary, a brother in England, and Mr. Kalman for fcho executor. Mr. Quartley said the estate was worth only £lO4. During the war deceased met the petitioner in England, and later married her. He had treated her badly and she was compelled to leave hum Scarff succumbed to injuries received at a football match. He left his estate to his brother and made no provision for his wife and child. Mr. Cocker said if the property was to be made over to the wife, deceased's brother wished that a watch and chain valued at £5 should be given to him for sentimental reasons. His Honor granted a decree awarding the estate to the widow, with the exception of the watch and chain which he directed should be forwarded to the brother. _______
